visited you and family in Albany
this Winter, but have been eighteen
days confined with the Rheumatism
and can now but just walk the floor[ . ]

If your family could come down
when the river opens we shall be high-
ly gratified to have them spend some

the same ground that we at first took

obstructions removed and the road open-
ed. It seems to me impossible the Su-
preme Court will ever sanction such

or some of them. We magnanimously
gave our land for a road to benefit all
this great Trust in the first place. We
innocently traveled the road and were
prossecuted time and again for Tresspass
in traveling it. We have under the ad-
vice of Counsel taken such measures
as the law proscribes for having the
road opened. We are now deprived
of the Use of our property and trespasers
are daily destroying it. If Concerns & harms
like these do not call for redress I know

Not what does. Is it not possible to have
this suit determined the Coming February[ . ]
Reason:
Has Mr Van Duzer furnished you with
the papers, will he be up. If not &
it carries on will you associate some
able man with your self to argue the
case. Would it not be well to have a
Map of the premeses to lay before the Court
this you can get made from the Map
of the Trust in their secretaries Office[ . ]
Reason:
I am told that let the desicions be as
it may the Town will be liable for Cost.
The proprietors are leasing yearly
ble the amount of the Cost by hass
and the worst of the road. If any farther
preparation is necessary for the trial let
me know and it shall be attended
there may be affedavits to
explain different parts of the Case. For
instance the time and manner in which
the road was laid as one Subject to over-
flowing &c &c. Will you write and let
me know how this business stands[ . ]
